1. Acceptance of Terms

By downloading, installing, or using Kova ("the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use Kova.

2. Description of Service

Kova is a macOS screen recording and video editing application. The Software allows you to record your screen, edit recordings with AI-powered tools, and export or share finished videos. Kova is available in two tiers:

• Free: All core recording and editing features with a Kova watermark on exports.
• Pro ($25/month or $60/year): All Free features plus AI auto-polish, no watermark, and priority support.

3. Account and Registration

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration.

4. Subscription and Billing

Payment for Pro subscriptions is processed by Paddle, our merchant of record. Subscriptions are billed on a recurring monthly or annual cycle. All prices are in USD. Subscriptions auto-renew unless cancelled before the end of the current billing period.

6. Acceptable Use

You agree not to:

• Record content without appropriate consent where required by law
• Use Kova to circumvent digital rights management (DRM) protections
• Reverse engineer, decompile, or disassemble the Software
• Use Kova for any purpose that violates applicable laws in your jurisdiction

7. Intellectual Property

Kova and its source code, design, and documentation are owned by Kova and protected by copyright and intellectual property laws. You retain full ownership of all recordings and exported content you create using Kova.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your information.

9. Limitation of Liability

Kova is provided "as is" without warranty of any kind. To the maximum extent permitted by law, Kova shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Software.

10. Termination

Kova may terminate or suspend your account at any time for violation of these terms. You may cancel your subscription and delete your account at any time. Upon termination, your right to use Pro features ceases, and your account downgrades to Free.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email. Continued use of Kova after changes take effect constitutes acceptance of the revised terms.

12. Governing Law

These terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles.
